C-PACE: Garden State Commercial Property Assessed Clean Energy

Note: In 2010, the Federal Housing Finance Agency (FHFA), which has authority over mortgage underwriters Fannie Mae and Freddie Mac, directed these enterprises against purchasing mortgages of homes with a PACE lien due to its senior status above a mortgage. Most residential PACE activity subsided following this directive; however, some residential PACE programs are now operating with loan loss reserve funds, appropriate disclosures, or other protections meant to address FHFA's concerns. Commercial PACE programs were not directly affected by FHFA’s actions, as Fannie Mae and Freddie Mac do not underwrite commercial mortgages. Solar-Ready Zones

This rule applies to new buildings seeking construction permits on or after January 1, 2025.

In 2023, Delaware HB 11 was enacted, adding a provision for "Solar-Ready Zones" to the commercial building code. These rules apply to new commercial buildings with a foundation footprint of 50,000 square feet or more.

Solar-Ready Zones are sections of the building's roof or overhang reserved for future installation(s) of solar photovoltaic or solar thermal energy systems.

Solar-Ready Zones shall be located on the roof of buildings up to 5 stories above grade with low-slope roofs or slanted roofs facing 110 to 270 degrees from

17.65.080.A.3.B - Maximum Floor Area Ratio

Regards the maximum floor area ratio regulation for the city of Oakland. It specifies the conditions for a conditional use permit for an FAR or up to 3.0 in the HBX-3 and HBX-4 zones. Including that “the additional Floor Area Ratio does not significantly decrease the solar access of existing adjacent single family homes or duplexes to a degree greater than would be created if the facility were built according to the base FAR.”

Santee Cooper - Commercial Energy Efficiency Rebate Program

The 2025 Santee Cooper Commercial Prescriptive Rebate Program helps businesses reduce energy costs by providing cash incentives for upgrading to high-efficiency equipment. Eligible measures include lighting upgrades, HVAC systems, refrigeration and kitchen equipment, domestic hot water improvements, pumps and motors, and smart thermostats. Rebates are available for both new construction and retrofit projects, covering technologies such as LED lighting, ENERGY STAR® appliances, variable speed drives, and efficient water heating systems. New Solar Market Development Tax Credit

New Mexico provides a 10% personal income tax credit (up to $6,000) for taxpayers that own a residence, business, or agricultural enterprise who purchase and install certified photovoltaic (PV) and solar thermal systems on their property or on property they lease from a federally recognized Indian nation, tribe, or pueblo. Ashland Electric Utility - New Construction Residential Energy Efficiency Rebate Program

The City of Ashland offers incentives to all news homes for energy and water efficiency projects. Program participants can select from any of the individually offered incentives for a partial rebate, or select all of the measures to obtain the maximum rebate of $2,500 and for the home to be recognized as an “Ashland Smartbuild” home. Texas Gas Service - Commercial Energy Efficiency Rebate Program

Texas Gas Service (TGS) offers a range of financial incentives to commercial customers who purchase and install energy efficient commercial equipment. Eligible categories for rebate includes food service equipment, water heaters, dryers and transportation. Direct install measures are also available through the TGS Commercial Direct Install Program. Purchased equipment must meet all TGS requirements for efficiency and installation.
